Terms and conditions of sale and use

Version of 17 September 2026.

1. SERVICE — Gate Pulse generates AI-assisted social media post proposals and publishes them after your approval. Provided "as is", on a best-efforts basis.

2. SUBSCRIPTION — Essentiel (€29/mo), Pro (€79/mo), Max (€149/mo), excl. VAT, billed monthly. Quotas and features per plan are shown in the app. 14-day withdrawal right for consumers (art. VI.47 CDE).

3. TERM AND RENEWAL — Subscriptions are taken without a fixed term, billed monthly. Where a 12-month commitment plan is offered, it grants the discount in art. 5. PAYMENT REMAINS MONTHLY: a 12-month commitment is a commitment of DURATION, not a prepayment — you are never charged 12 months upfront. At the end of a committed period the subscription continues month-to-month, with no tacit renewal of a new commitment. Gate.IA notifies you by email at least 30 days before the end of a committed period.

4. TERMINATION — Without commitment: cancel anytime; effective at the end of the current, already-paid month; no pro-rata refund. With commitment: effective at the end of the committed period. EARLY TERMINATION: the commitment discount ceases to apply retroactively and Gate.IA may invoice the difference with the no-commitment rate for months already served — this is the consideration for the discount granted, not a penalty. Gate.IA may suspend then terminate for persistent non-payment after a 15-day unanswered reminder, or for serious breach of art. 7. Ending a subscription does not erase your content: you have at least 30 days to export it, and no automatic deletion follows that period. Your content is erased only when YOU delete your account — possible at any time from the app, with immediate effect, subject only to the 14-day backup retention stated in the privacy policy.

5. DISCOUNTS AND PROMO CODES — A 12-month commitment, where offered, grants 5 % off the monthly rate for its duration. A valid promo code grants its stated discount for the term subscribed, is usable once per account, and is only consumed on confirmed payment. Discounts stack up to a global cap of 20 %. On the Essentiel and Découverte plans discounts DO NOT STACK: the most advantageous one applies automatically. No discount is applied retroactively.

6. SOCIAL ACCOUNTS AND FRAUD PREVENTION — A social media account may be linked to only ONE Gate Pulse account; the first to link it retains exclusivity. This reservation survives disconnection of the social account and deletion of the Gate Pulse account, for the sole purpose of preventing repeated free trials with the same social account. To have it released (business handover, previously deleted account), write to contact@gate-ia.be quoting the reference shown on refusal (format SOC-xxxxxx); handled within 2 business days after verifying you administer the account. Only a non-reversible cryptographic fingerprint of the account identifier is kept, for 24 months from last use.

7. FAIR USE AND SERVICE CHANGES — The subscription is for your own professional use; resale, sharing one account across distinct entities, and automated use producing volumes clearly unrelated to normal professional use are excluded. Gate.IA measures usage volumes and will CONTACT YOU before any restriction. Gate.IA may introduce or change monthly usage limits, notified by email at least 30 days in advance; if you do not accept, you may terminate free of charge within that period, including during a commitment. Price changes follow the same rules; rates are frozen until the end of an ongoing commitment.

8. YOUR RESPONSIBILITIES — you remain solely responsible for published content (the AI proposes, YOU approve), compliance with third-party platform terms (Meta), rights over uploaded images, and credential confidentiality.

9. AI — AI output may contain errors. Human approval before publishing is a mandatory step, not an option. No audience, reach or engagement result is guaranteed.

10. LIABILITY — limited to the last 12 months of subscription fees paid, excluding indirect damages. The service depends on third-party APIs (Meta, Anthropic).

11. GOVERNING LAW — Belgian law.

12. OWNERSHIP OF WHAT IS PRODUCED — your content stays yours; you grant us only the right to process it in order to provide the service, for as long as that requires. The texts and proposals produced by the service belong to you from the moment they are produced: you may use them freely, including commercially and after your subscription ends, with no royalty and no attribution owed to Gate.IA. Gate.IA claims no right over them and reuses them for no other account. RESERVATION: AI-produced content may not be protectable by copyright, and a similar request from another customer may produce a similar result. That is not within our control, so we cannot guarantee you exclusivity over a wording.

13. MODEL TRAINING — [article to be carried over from the version shown inside the application, once the publisher has checked the agreement in force with the model provider. It states a commitment that cannot be read from the service itself, and this page is public.]

14. FREE TRIAL (DÉCOUVERTE PLAN) — new accounts start on the Découverte plan. It is free and requires NO PAYMENT CARD: none is asked for at sign-up, so nothing can be charged until you choose a paid plan yourself. It opens one post per day and one connected social account (Instagram OR Facebook), with AI-assisted writing — access is aligned on Essentiel: scheduling, variants, sector study, weekly plan and extended reasoning stay with the paid plans. Its duration is whatever the app states at sign-up, and it MAY BE ZERO: during early access the trial can be suspended and Découverte then opens with no end date — as long as no end date is shown to you, your Découverte access does not expire by itself. Where an end date was set, on expiry you can no longer generate or create new posts; NOTHING IS DELETED — account, texts, images and settings stay in place, readable and exportable, and you find them unchanged when you subscribe. The trial never turns into a paid subscription on its own. ONE TRIAL PER SOCIAL ACCOUNT: Découverte cannot be bought and does not renew, and an Instagram or Facebook account already linked to a Gate Pulse account will not open a second one (art. 6). Gate.IA may change, suspend or reopen the trial for future sign-ups, without changing an ongoing one.

15. NOTIFICATIONS AND COMMUNICATIONS
15.1 What the service emails you. These are part of the service and CANNOT BE TURNED OFF — without them the account cannot be used, or a security event would go unnoticed: your verification code with a backup link at sign-up; a one-off welcome message once the address is verified; an alert when a login comes from a device we do not know (date, browser, start of the IP address); an alert when your password has just been changed; a reset link when you ask to change a forgotten password; and a warning sent to YOUR address if someone tries to create an account with it — that message tells the requester nothing, it warns you.
15.2 Notices required by this contract travel by the same channel and cannot be turned off either: approaching end of a committed period (art. 3.5), new or changed usage limits (art. 7.3), price changes (art. 7.4), suspension or termination (art. 4.4).
15.3 What we do not send: no newsletter, no marketing message, no commercial follow-up. Our emails carry no tracking pixel — we measure neither opens nor clicks.
15.4 Optional communications. None: we send neither newsletters nor periodic digests. The only emails that go out are those of articles 15.1 and 15.2. Should an optional communication ever be offered, it would be presented in the app, off by default, and sent only after your explicit choice.
15.5 Addresses. Our messages come from info@gate-ia.be; replies reach support@gate-ia.be for anything blocking your use, and contact@gate-ia.be for legal and commercial matters. You are responsible for keeping a valid, monitored email address on your account: password recovery and every notice under this contract travel through it.
15.6 In the app. Everything else — post sent or failed, quota reached, product news — is shown inside the application and generates no email.

16. COMPLAINTS, MEDIATION AND DISPUTES — write to contact@gate-ia.be first; we answer. Gate Pulse is designed for professional use (art. 7.1), but sign-up asks for no company number, no VAT number and no declaration of status: nothing stops a private individual from subscribing today. If one does, they keep EVERY right Belgian and European law gives consumers — including the 14-day withdrawal right of art. 2 — and no clause here can take them away. Before going to court, a consumer may ask free of charge for the Belgian consumer mediation service (mediationconsommateur.be), which routes the request to the competent body; for a cross-border dispute within the EU, the European Consumer Centre Belgium (eccbelgique.be) also assists free of charge. NOTE: the European Online Dispute Resolution (ODR) platform, still linked to by many terms, ceased operating on 20 July 2025 — national mediation above replaces it. A consumer may also report a breach to the Belgian Federal Public Service Economy (economie.fgov.be). None of this prevents you from going straight to the competent court (art. 11).

ANNEX 1 — WHEN WE WORK FOR YOU (GDPR ART. 28)
[TEMPLATE, TO BE REVIEWED BY A LAWYER — not professionally validated.]
The French version of this annex prevails; what follows is a summary.
WHY IT EXISTS — two kinds of data live in Gate Pulse. Yours (name, address, subscription): we are the controller, and the privacy policy applies. Other people's — those who comment on your posts, those your texts name, those pictured in your images, and the engagement figures we read back from Meta to analyse your style. We did not collect those: they come from your activity, and YOU answer for them in law. You are the controller; we are your processor. This annex is the contract art. 28 GDPR requires between those two roles. It forms part of these terms and applies as soon as you connect an Instagram or Facebook account.
A. SUBJECT AND DURATION — reading your past posts and their engagement figures, deriving a style profile, producing text proposals, and publishing what you approved. For the duration of your subscription and, beyond it, as long as your account exists. Operations: collection, reading, AI analysis, storage, transmission to Meta on publication, erasure. That purpose only; we pursue no purpose of our own with this data.
B. DATA AND PEOPLE — text of past posts (which may name or describe people), images you upload (which may show people), like and comment counts, publication dates, technical identifiers of connected accounts. People: your followers and those interacting with your posts, people your texts mention, people in your images, employees using the account with you. NO SENSITIVE DATA (health, opinions, religion, orientation, origin, identifiable images of children) is to be entered: nothing is in place to protect it further, and uploading it is your responsibility.
C. YOUR INSTRUCTIONS — we process only on your instructions, which are these terms and the actions you take in the app. If an instruction appears to breach the GDPR we say so and do not carry it out. This data leaves the EU only as described in the privacy policy (the writing engine is US-based), under standard contractual clauses or an adequacy decision.
D. CONFIDENTIALITY — only the people operating the service, strictly as their work requires, bound to confidentiality including after their assignment ends. [Number of people and signed confidentiality undertaking: to be completed by the publisher.]
E. SECURITY — the measures set out in the "Security" document, which forms part of this annex. What that document does not promise applies here too: no measure makes a service impregnable.
F. SUB-PROCESSORS — you give general authorisation for the providers listed in the privacy policy, each bound by an at-least-equivalent agreement. We tell you by email before adding or replacing one; if that does not suit you, you may terminate free of charge before it takes effect. We answer for them as for ourselves.
G. DATA SUBJECT REQUESTS — if someone asks you what you hold about them, YOU answer: they wrote to you, not to us. We assist as far as our means allow, free of charge while the request stays reasonable — export is one button in the app, and deleting your account erases everything we hold. A request reaching us directly is forwarded to you, not handled by us. To know before you commit: we have no tool able to extract or erase ONE third party's data from inside your content.
H. BREACH NOTIFICATION — if we discover a security breach affecting this data we tell you WITHOUT UNDUE DELAY, with what happened, which data, roughly how many people, likely consequences and what we are doing. You then decide whether to notify the supervisory authority and the people concerned: the law places that duty on the controller, so on you. We give you what you need. What concerns our own processing, we notify ourselves.
I. END OF CONTRACT — when the subscription ends we erase nothing on our own initiative; your content stays exportable while the account exists (art. 4.5). When you delete your account everything is erased at once, except what backups hold for at most 14 days and the records named in the privacy policy that survive anonymised or as proof. You may export at any time before deleting; we keep no other copy.
J. AUDIT — you may ask us in writing for the information needed to check that we comply, and we answer within a reasonable time. An on-site or third-party audit is possible once a year, at your cost, on reasonable notice, in business hours, without disrupting the service — and more often if a supervisory authority requires it. [Exact terms to be settled with a lawyer.]
K. PRECEDENCE — where this annex and the rest of the terms conflict, this annex prevails for anything concerning third parties' data.
